MAMSA, INC. Refund Policy
Effective Date: June 1, 2026 

1. SCOPE

1.1 This Refund Policy applies to all purchases made through the Mamsa, Inc. platform at www.mamsacare.com and governs your rights with respect to refunds and the statutory 14-day withdrawal right under applicable consumer protection law, including EU Directive 2011/83/EU on consumer rights.

1.2 This Policy forms part of, and should be read together with, the Mamsa, Inc. Terms of Service.

2. THE PRODUCT

2.1 Mamsa offers a digital health screening service. Upon payment, you receive immediate access to: (i) the voice recording tool; (ii) the voice biomarker screening tool; and (iii) the results of your voice biomarker analysis report. These three components together constitute the complete deliverable, and access to all three is granted simultaneously at the moment of purchase.

2.2 The service is delivered digitally and instantaneously. There is no physical product and no deferred delivery.

3. STATUTORY 14-DAY WITHDRAWAL RIGHT

3.1 Under EU consumer protection law, you ordinarily have the right to withdraw from a digital content purchase within 14 days of the transaction without giving any reason.

3.2 However, under Article 16(m) of EU Directive 2011/83/EU, this right to withdrawal is expressly excluded for digital content that has been supplied and where performance has begun with the consumer's prior express consent and acknowledgment that the right of withdrawal is thereby lost.

3.3 At the point of purchase and prior to submitting your voice sample, you will be presented with an explicit consent checkbox confirming that:

  • You request immediate performance of the digital service;
  • You acknowledge that by proceeding to record your voice sample, you waive your 14-day statutory right of withdrawal.

3.4 If you check this box and proceed to record your voice sample, your right of withdrawal is extinguished at that moment. No refund will be available on this basis thereafter.

3.5 If you have purchased the Service but have not yet recorded your voice sample, your 14-day withdrawal right remains intact. You may exercise it by contacting us at legal@mamsacare.com before submitting any voice recording. In that case, you will receive a full refund with no deduction.

4. NO REFUNDS AFTER VOICE SAMPLE SUBMISSION

4.1 Once you have submitted a voice sample, the Service has been fully performed and the digital content has been delivered. No refund will be issued on the basis that:

  • You are dissatisfied with the result or its conclusions;
  • The result did not meet your expectations;
  • You have changed your mind following delivery;
  • You dispute the accuracy of the analysis.

4.2 This applies regardless of whether you reviewed the result, shared it with a healthcare professional, or took any action on the basis of it. Delivery occurs at the moment of analysis, not at the moment of your review.

5. EXCEPTIONS — TECHNICAL FAILURE

5.1 Notwithstanding Section 4, you are entitled to a full refund where:

  • A technical failure on the Company's side prevented the analysis from being completed and delivered; or
  • You were charged but received no output due to a system error attributable to the Company.

5.2 To request a refund on this basis, contact legal@mamsacare.com within 14 days of the failed transaction, describing the issue. The Company will investigate and respond within 5 business days. Where the failure is confirmed, a full refund will be processed within 14 days of that confirmation.

5.3 Processing fees charged by third-party payment providers are non-refundable and will be deducted from any refund where technically unavoidable.

6. HOW TO REQUEST A REFUND

6.1 All refund requests must be submitted to legal@mamsacare.com and must include:

  • Your full name;
  • The email address associated with your purchase;
  • Date of purchase;
  • Order or transaction reference number;
  • A clear description of the basis for your request.

6.2 Requests that do not include this information may be delayed or declined.

7. GOVERNING LAW

7.1 This Policy is governed by the laws of the State of Delaware, United States. Where you are located in the European Union or European Economic Area, your mandatory statutory consumer rights under applicable EU law are not affected by this Policy and take precedence to the extent of any conflict.
